Colombia Activa S.A.S (or “we”) is a company registered in Colombia which acts as an intermediary between you and independent operators in connection with the purchase of travel goods or services on your behalf. You represent that any payment made by you to Colombia Activa in connection with a trip constitutes your acceptance of the terms and conditions set out below (“Terms and Conditions”). Reservations/Payment: If making a reservation forty (40) or more days in advance of trip commencement, we require a deposit of fifty percent (50%) of the total cost of the contracted services (excluding air services), and one hundred percent (100%) of the total cost of air services. The balance remaining is due 40 days prior to trip commitment. Reservations made less than forty (40) days in advance of trip commencement require full payment. Payment Methods: We accept all major credit cards (American Express, Visa, Mastercard). All payments by credit are subject to a four percent (4%) surcharge. At the time of booking, we will request your credit card information. You agree that, unless expressly instructed by you in writing, if you request additional services during your trip, Colombia Activa is authorized to debit these charges to the credit card you provided upon booking. Payments may also be made via wire transfer to Colombia Activa’s account. Cancellation Policy*: All cancellations shall be made in writing. If you cancel your reservation, the following cancellation fees shall apply: Dates Fee per person 60-45 days prior to your departure date 20% of amount deposited 20-44 days prior to your departure date 50% of total trip cost 0-19 days prior to your departure date 100% of total trip cost *Depending on specific supplier cancellation policies, the above conditions may be subject to change. Air services: All air travel quotes are subject to change and may carry surcharges or penalties prior to full payment by you and booking confirmation by Colombia Activa. CANCELLED/RETURNED AIRLINE TICKETS: Colombia Activa will reimburse clients when the credit is received from the airline companies, this may take up to 90 days. You agree that in reserving, purchasing or otherwise arranging your air travel, Colombia Activa is acting solely as your agent and that your airline ticket constitutes a contract between you and the airline (and not Colombia Activa). Colombia Activa is not responsible and assumes no liability for any claims in connection with, without limitation, seat assignments, overbooking, union unrest, flight schedule changes, delays, cancellations, claims for refunds or reimbursements, or insolvency or bankruptcy of the airline. Itineraries: Although Colombia Activa will make every effort to operate itineraries (including air and land transportation) as planned, all prices, quotes, rates, services, schedules, programs, activities and accommodations are subject to cancellation or change by Colombia Activa at any time without prior notice due to circumstances that are unforeseen or beyond Colombia Activa’s control, and Colombia Activa is not responsible for any additional costs or expenditures incurred as a result thereof. Colombia Activa reserves the right to make any alterations or changes in the itinerary it deems necessary or desirable. Special Requests: Although Colombia Activa will strive to accommodate special requests made at the time of booking (for example, early check-in, connecting/adjacent rooms, smoking/non smoking rooms and special dietary requests), Colombia Activa makes no guarantee in connection with such requests. Refunds of pre-booked services: If an operator cancels any pre-booked and paid service (including without limitation, a tour, activity, cultural or other experience) for any reason, such service will be subject to a refund, provided that (a) requests for refunds are received within thirty (30) days of the last day of the trip and (b) such requests are accompanied by supporting documentation of error or negligence by the operator and (c) the amount of the refund shall not exceed the amount returned by the operator. There will be no refunds of any pre-booked and paid service that is cancelled or otherwise missed by the client. Health and Insurance: There are many risks inherent to traveling, especially when traveling to remote locations. You represent that you and any family members or dependents traveling with you are in sufficient health to undertake the trip. We strongly recommend that you consult a physician prior to booking your trip, and that you review and adjust, if applicable, your personal and health insurance to ensure that you and your family and/or dependants have coverage appropriate to meet your needs, in case of any loss of property, medical emergency, illness, injury or death. Limitation of Liability: Colombia Activa, its employees, officers, shareholders, directors, successors and assigns are not liable for any costs, damages, loss, inconvenience, death or injury resulting directly or indirectly from (a) the acts or omissions of any person, provider, operator or entity which provides goods or services in connection with your trip, (b) mechanical or other failure of any aircraft, watercraft or other vehicle, laws, regulations or other acts of government or cuasi government entities or officials, acts of God, force majeure, strikes, accidents, fire, flood or other extreme weather, political unrest, war, terrorism, epidemic, animals or criminal activity, or any other cause beyond Colombia Activa’s control. You hereby waive any claim against Colombia Activa for any such cost, damage, loss, inconvenience, death or injury. Jurisdiction: any claim or controversy arising out of or relating to these Terms and Conditions shall be settled by the Commercial Courts of Colombia.
